Congress has become unable to check, or balance, the Executive Branch power of the government. Congress is seeking help from the Judicial Branch of government to re-gain the power of the people over the power of the presidency.
The previous 7 years have been a watershed in determining whether America will become an ‘elected constitutional monarchy’ or remain a Republic. The Bush presidency was originally emboldened by a sycophantic Republican Congress that permitted the president to declare war whenever he felt it necessary. Later, Congress enabled the Executive Branch to kidnap, capture, detain indefinitely, and torture those people that the president determined were enemy combatants regardless of their citizenship. Congress also permitted the Executive Branch to surveil any American citizen thru the use of National Security Letters. Those letters allowed Executive Branch officials to secretly obtain the private communications, financial records, purchasing records, medical records, and private company files of any American it so chooses using any designated federal policing authority. No requirements were made to substantiate the need for such documents. In addition, no one from whom such a request demand was made could divulge at any time the source for that request demand or the target of that request demand.
The Executive Branch of government utilized its new found powers to craft a deceptive justification for attacking Iraq. It also used those powers to spy on journalists and citizens with Middle Eastern friends and colleagues. The Executive Branch kidnapped people from around the world and utilized available means to coerce them to talk. Uncooperative detainees were progressively subjected to punishments until they broke. The Executive Branch then used the power of secrecy to prevent Congress from oversight review and to prevent alleged enemy combatants from restitution for losses suffered while in and out of custody. After that, the Executive Branch purged itself of federal lawyers capable of resisting the Executive Branch’s unconstitutional and illegal activities to acquire more power for itself.

Today Congress is less sycophantic but it is unable to bring the Executive Branch under Congressional oversight. No longer able to assert the power of the people over the power of the presidency, Congress has been weakened by its own delegation of Constitutional powers to the Executive Branch.
The Office of the President of the United States no longer respects Congress and thus asserts itself as the sole decision making authority on all actions.
Congress has neutered itself and seeks Judicial testosterone to restore its virility.
Will it succeed?
